North Dakota State Bankruptcy Exemptions
Laws That Keep Your Creditors' Hands Off Your Property
Exemptions are laws passed by every state that allow you to protect certain
types of your property from your creditors when you file bankruptcy-such as
your home, car, pensions and IRAs, motor vehicles, clothing, tools, and other
important property. North Dakota law provides a number of exemptions that
protect your property, and your attorney will be able to advise you on which
exemptions are best for you.
Homestead
$80,000 homestead exemption.
Wages
75 percent of weekly earnings exempt.
Automobiles
One motor vehicle not to exceed $1,200; $32,000 for a vehicle that
has been modified at a cost of not less than $1,500 to accommodate an
individual with a permanent physical disability who is the owner of that motor
vehicle.
Other Property
All family pictures; one church pew; one burial ground; family Bible and books
not exceeding $100; clothing; food and fuel for one year; crops and
grain; all other personal property including money not to exceed $5,000.
