South Dakota State Bankruptcy Exemptions

Laws That Keep Your Creditors' Hands Off Your Property

Exemptions are laws passed by every state that allow you to protect certain types of your property from your creditors when you file bankruptcy-such as your home, car, pensions and IRAs, motor vehicles, clothing, tools, and other important property. South Dakota law provides a number of exemptions that protect your property, and your attorney will be able to advise you on which exemptions are best for you.

Homestead

100 percent of homestead is exempt.

Wages

100 percent of 60 days earnings if needed to support family; otherwise, 80 percent or 40 times the federal minimum wage whichever is greater.

Automobiles

No specific automobile exemption.

Other Property

All family pictures; church pews and burial lots; $200 in all books; all clothing; all food and fuel; $6,000 in personal property of any kind for the debtor.
