Laws That Keep Your Creditors' Hands Off Your Property
Exemptions are laws passed by every state that allow you to protect certain
types of your property from your creditors when you file bankruptcy-such as
your home, car, pensions and IRAs, motor vehicles, clothing, tools, and other
important property. West Virginia law provides a number of exemptions that
protect your property, and your attorney will be able to advise you on which
exemptions are best for you.
Homestead
$25,000 exemption for the debtor's interest in real or personal property.
Wages
No specific exemption.
Automobiles
$2,400 for one motor vehicle.
Other Property
$400 per item (and $8,000 in the aggregate) in household
furnishings, household goods, clothing, appliances, books, animals, crops and
musical instruments; $1,000 in jewelry; $1,500 in books and tools
of trade.
