Consumer Education Services, Inc. (CESI), doing business as Start Fresh Today (SFT), is a provider of both the Pre-Bankruptcy Credit Counseling and the Post-Bankruptcy Personal Finance Debtor Education course, each service approved and delivered in accordance with the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005. These interactive courses fulfill your BAPCPA Credit Counseling and Debtor Education Course requirements. Only upon completion of this briefing will Consumer Education Services, Inc. (CESI), d/b/a Start Fresh Today (SFT), issue you the required bankruptcy certificate. It is your responsibility to ensure that your attorney has received your certificate by the date required for your filing.

Consumer Education Services, Inc.’s (CESI), d/b/a Start Fresh Today (SFT), does not offer legal advice or opinions on the suitability or availability of bankruptcy as an option for you. While we may describe or define bankruptcy terms in general, at no time will we make any determination about the applicability of such terms or scenarios to your specific circumstances.

Federal law requires that Consumer Education Services, Inc. (CESI), d/b/a Start Fresh Today (SFT), make the following disclosures to you.

Disclosures Pre-Discharge Personal Financial Management Instruction Courses (Debtor Education)

  • *Consumer Education Services, Inc. (CESI), d/b/a Start Fresh Today (SFT), has been approved by the Executive Office for United States Trustees (EOUST) to issue certificates in compliance with the Bankruptcy code for Pre-Discharge Personal Financial Management Instruction Courses (Debtor Education). EOUST has reviewed only those counseling and education services related to bankruptcy, but has not reviewed or approved any other counseling services provided by Consumer Education Services, Inc. (CESI).
  • Federal law requires that Consumer Education Services, Inc. (CESI), d/b/a Start Fresh Today (SFT), may disclose your information to EOUST, but we will not release your information to any other person or entity without your prior approval.
  • Consumer Education Services, Inc. (CESI) is funded by fees charged for pre-bankruptcy credit counseling briefings and pre-discharge debtor education courses. We are also funded by client fees and creditor contributions from non-bankruptcy-related debt management plans, and through grants related to our housing counseling or other charitable and educational efforts in the community.
  • All instructors who are assisting and facilitating course content are employees of Consumer Education Services, Inc. (CESI). Counselors are required to obtain certification through the Center for Financial Certifications (CFC, a division of the Institute for Financial Literacy) within 6 months of employment.
  • Although an instructor may answer general questions about bankruptcy, the agency does not provide legal or tax advice. If legal or tax advice is needed, you should seek appropriate assistance from an attorney or tax professional.
  • Federal law requires that Consumer Education Services, Inc. (CESI), d/b/a Start Fresh Today (SFT), does not disclose or provide to any credit reporting agency information concerning an individual’s participation in debtor education programs offered through our agency. Filing for bankruptcy is reported as a matter of public record and may impact your credit reports and scores. Please check with your legal counsel regarding this matter.
  • The fee for our services is based on each client’s ability to pay the exact fee you will pay for this service is shown or populated in your shopping cart. If you are unable to pay the fee, the counseling will be provided at a reduced fee or at no charge, as described in the fee waiver disclosure below. We accept VISA, MasterCard, Amex, and VISA or MasterCard branded debit cards.
  • Individuals who do not speak English as their primary language or who have difficulty understanding English may request communication in another language at no charge. Federal law requires that Consumer Education Services, Inc. (CESI), doing business as Start Fresh Today (SFT), will provide communication in the requested language if a suitable instructor or translator is available; otherwise, we will promptly provide a referral to another appropriate provider.
  • Federal law requires that Consumer Education Services, Inc. (CESI), d/b/a Start Fresh Today (SFT), does not pay or receive fees or other consideration for referrals.
  • Federal law requires that Consumer Education Services, Inc. (CESI), d/b/a Start Fresh Today (SFT), will issue an appropriate Certificate of Completion to each qualifying individual no later than one business day after successful completion of the counseling session.
  • The client has the opportunity to negotiate an alternative payment schedule with regard to each unsecured consumer debt under terms as set forth in 11 U.S.C. 502(k). Consumer Education Services, Inc. (CESI), doing business as Start Fresh Today (SFT) does not currently offer this service to bankruptcy clients but may refer the client to another approved agency. Clients may incur additional fees in connection with such a referral

Fee Waiver

Consumer Education Services, Inc. (CESI), d/b/a Start Fresh Today (SFT), agrees to review each consumer’s or debtor student’s circumstances to determine eligibility for a fee waiver. If the consumer or debtor student has income less than 150 percent of the applicable poverty guideline as published by the United States Department of Health and Human Services (DHHS) (http://aspe.hhs.gov/poverty/15poverty.cfm) for the 48 contiguous states, their fee may be reduced or waived.

 

Please Note:

  1. The income provided during your counseling session will be used for comparison to the poverty guidelines.
  2. Non-cash governmental assistance (such as food stamps or housing subsidies) is not included in calculating debtor income.
  3. The income of a spouse is included in calculating income whether or not a joint petition is filed, unless the spouses are separated and a joint petition is not filed.
  4. The income of any other family member listed on Schedule I as a dependent also is included.
  5. Household income and household size are also used in the waiver determination process. If you are completing the Debtor Education Course, you have the right to opt out of providing such household information for consideration of a waiver.
